This Pontoon Rental Agreement ("Agreement") is entered into between Gull Point Villas ("Owner") and the undersigned Guest ("Renter").
The Renter accepts full responsibility for any damage, loss, theft, or injury occurring during the rental period due to negligence or misuse. Gull Point Villas shall not be liable for injuries, accidents, lost property, weather-related interruptions, or other damages arising from the Renter's use of the pontoon.
The Renter acknowledges that boating involves inherent risks and voluntarily assumes all risks associated with operating and riding on the pontoon. The Renter agrees to indemnify and hold harmless Gull Point Villas, its owners, employees, and managing agents from any claims, damages, liabilities, costs, or expenses arising out of the Renter's use of the pontoon.
The Renter acknowledges the pontoon has been inspected prior to departure and accepts it in good operating condition unless otherwise noted. The Renter acknowledges the pontoon rental comes with one full tank of gas and it is the Renter's responsibility to purchase additional gas upon usage.
This Agreement shall be governed by the laws of the State of Minnesota.
A signed agreement and full payment are required prior to use of the pontoon unless otherwise agreed upon by Gull Point Villas managing agent Cabin Keys LLC.
A $500 damage deposit is required before the rental period begins. The security deposit will be refunded after the pontoon has been inspected and determined to have been returned:
Cabin Keys, LLC reserves the right to retain all or part of the security deposit to cover damage, excessive cleaning, missing equipment, fuel charges (if applicable), or other costs resulting from the Renter's use of the pontoon. If damages exceed $500, the Renter agrees to be responsible for the full cost of repairs or replacement.
