This Pontoon Rental Agreement ("Agreement") is entered into between Gull Point Villas ("Owner") and the undersigned Guest ("Renter").

The Renter agrees to

• Operate the pontoon in a safe and responsible manner.
• Comply with all federal, state, and local boating laws and regulations.
• Ensure only competent operators age 21 or older operate the vessel.
• Never operate the pontoon while under the influence of alcohol or drugs.
• Keep all passengers within the manufacturer's maximum capacity.
• Wear or have readily available all required life jackets.
• Avoid shallow water, submerged hazards, docks, and other obstacles.
• Immediately report any accident, damage, or mechanical issue to Gull Point Villas managing agent Cabin Keys, LLC.

Strictly prohibited

• Towing tubes, skiers, wake-boards, or similar water sports unless expressly authorized.
• Operating after sunset or before sunrise without the proper legal use of lights.
• Reckless or negligent operation.
• Allowing unauthorized persons to operate the pontoon.
• Smoking or illegal drug use aboard the vessel.

Damage and Liability

The Renter accepts full responsibility for any damage, loss, theft, or injury occurring during the rental period due to negligence or misuse. Gull Point Villas shall not be liable for injuries, accidents, lost property, weather-related interruptions, or other damages arising from the Renter's use of the pontoon.

Assumption of Risk

The Renter acknowledges that boating involves inherent risks and voluntarily assumes all risks associated with operating and riding on the pontoon. The Renter agrees to indemnify and hold harmless Gull Point Villas, its owners, employees, and managing agents from any claims, damages, liabilities, costs, or expenses arising out of the Renter's use of the pontoon.

Inspection

The Renter acknowledges the pontoon has been inspected prior to departure and accepts it in good operating condition unless otherwise noted. The Renter acknowledges the pontoon rental comes with one full tank of gas and it is the Renter's responsibility to purchase additional gas upon usage.

Governing Law

This Agreement shall be governed by the laws of the State of Minnesota.

Rental Information

A signed agreement and full payment are required prior to use of the pontoon unless otherwise agreed upon by Gull Point Villas managing agent Cabin Keys LLC.

Security Deposit

A $500 damage deposit is required before the rental period begins. The security deposit will be refunded after the pontoon has been inspected and determined to have been returned:

• In the same condition in which it was rented, normal wear excepted.
• With no damage to the boat, motor, propeller, upholstery, canopy, electronics, trailer (if applicable), or accessories.
• With all provided safety equipment returned.

Cabin Keys, LLC reserves the right to retain all or part of the security deposit to cover damage, excessive cleaning, missing equipment, fuel charges (if applicable), or other costs resulting from the Renter's use of the pontoon. If damages exceed $500, the Renter agrees to be responsible for the full cost of repairs or replacement.
